Starlight Cinema retains all rights, title, and interest in and to the Website and Services, including all associated intellectual property rights. This includes, but is not limited to, trademarks, logos, software, and content.
You retain ownership of the content you provide to Starlight Cinema for use in video production projects ("Client Content"). However, you grant Starlight Cinema a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute Client Content for the purpose of providing the Services.
Upon full payment for the Services, you will own the final video product, subject to any third-party licensing restrictions (e.g., music licenses, stock footage licenses). Starlight Cinema retains the right to use the final video product for promotional purposes, unless otherwise agreed upon in writing.
Payment terms will be outlined in the project agreement. Typically, we require a deposit before commencing work, with the remaining balance due upon completion of the project. We accept various forms of payment, including credit cards, checks, and electronic transfers. Late payments may be subject to interest charges. Details regarding invoicing and payment schedules will be clearly communicated.
If you cancel a project before completion, you may be subject to cancellation fees. The amount of the cancellation fee will depend on the stage of the project and the expenses incurred by Starlight Cinema. Refund policies will be detailed in the project agreement. We encourage open communication regarding any potential cancellation to minimize any financial impact.
To the fullest extent permitted by applicable law, Starlight Cinema shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Website or Services; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Website or Services; (d) any bugs, viruses, Trojan horses, or the like that may be transmitted to or through the Website or Services; or (e) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the Website or Services, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not Starlight Cinema has been advised of the possibility of such damages.
